Grenigeech – The evolution of Fiefdoms in Music.

Which Fief Do You Claim?

The music industry is a mess. We are being frank here. Thats is why we call current events “Grenigeech” (Gra-`Nee-Geech), a Kickradio term meaning worldwide music feudalism, of sorts.

Things are just not the same anymore. Conglomerates have eaten up the major record labels. What used to be major lable companies exclusively devoted to the business of producing and making music superstars and the selling of records now have evaporated and been consumed by larger conglomerates that are so diversified that music making is only a very smaller player owned and controlled by much larger megalithic empires that manufactures everything from fiber optics to home entertainment centers to lightbulbs.

If you don’t believe this industry is evolving then at least please recognize that home computers now pack powerful software that rivals quality and performance with major record studios.

And to top it all off, digital downloads of of file music are a way of life.

MicroSD memory cards the size of your small fingernail — but packing up to 8 and 16 gigs of storage can interchange with PCs, cell phones, cameras, mp3players and even high end home stereo systems and televisions — literally obsoleting CDs, DVDs just like Cassettes obsoleted 8-track players. The manufacturing industry has been and will continue to profit from this technology.

Meanwhile, unfortunately, the brick and mortar record stores where you used to go and browse for 45s and LP vinyls (and lated cassettes and Cd’s) are closing in record numbers. Why?

Major labels, who have been moaning and wringing their hands about catastrophic losses in music revenues, blame digital downloads of music via the internet as the culprit and have even lowered themselves to suing consumers who download said digital music files.

An irony that cannot go unnoticed when one considers that these same major players manufacture the very media that downloaders use to contain and play those same digital files. Sony, for example, is not only a major record label (most know them as the owner of much of the late Michael Jackson’s contracts) but also the manufacturers of CD’s, DVD’s, Home Entertainment Centers (Stereo and Televisions), MP3 players as well as the very duplication systems and PC studio software that can duplicate and or play the same.

But the truth hurts, right?

Napster, in it’s original form, opened a musical Pandora’s box with its original free file-sharing internet download system. It has always intrigued us that they used a cat for their logo – LOL… Thats why we like to say that Napster “let the cat out of the bag”, and by doing so changed the music industry forever.

The consuming public was hooked. Actually it was nothing new as music lovers previously traded music via magnetic tape such as 8-tracks, reel-to-reels and cassettes. But this time it was new, different, fast and involved millions and millions (perhaps even billions) of downloaded MP3s. The music industry cried foul, claiming that the practice cost them hundreds of millions of dollars in lost revenues — but in fact were making tons of payola cash via the manufacture of media that a MP3-hungry consuming public needed to make those same MP3 files work.

Now why do you suppose we are even bringing this up?

Because we are tired of living a lie. It has all been a smokescreen. Musicians, songwriters and performers have been duped.

Duped?

Right! Those terrible citizen consumer downloaders are pirates, right? The RIAA and the record industry says so. After all, they are the victims here, right?

WRONG!

Do you want a Fiefdom or a Kingdom?

While they have filed a handful of DRM copyright suits against innocent consumers collecting substandard digital copies of music they have been involved with being the very same guys that manufacture the very media that theconsumers use to play the music.

Sony and Philips own the patents to the CD and DVD. Sony manufactures CD and DVD players and software that burns those very same CDs and DVDs. Think about it! The very people suing those downloaders are providing the very technology and equipment that the downloaders use to play the downloads.

Even more troubling is the fact that songwriters and performing artists have been duped. A smokescreen to make them feel they are losing revenues to downloaders — or income opportunity lost (a pathetic economic assumption that every download would have been a cash sale) to pirates.

But the fact is these same companies through their conglomerate corporate shells are selling the equipment and blank media that downloaders and traders need to actually play the music. If the media and equipment did not exist then downloading would be restricted to just bad copies via the internet and not opportunity lost at all.

The big money is in the sales of the blank media and the the equipment that duplicates it and plays it.

The same groups that want to make you believe the villain is pirates who download are cheating every creative music songwriter and artist because THEY ARE PAYING LITTLE TO NO COMMISSIONS ON THE PROFITS THEY MAKE FROM SALES OF PLAYERS AND BLANK MEDIA that the so-called pirates use and average ordinary consumers use.

In fact they want you to buy this equipment and the media that plays in it. Just take a jaunt to your local WalMart store and go to the entertainment department and look at the entertainment players there. You will notice most of them play CDs, DVDs, MP3 and MP4 files and much more…Plus youy can buy duplication equipment as well. How much do our major label artists and songwriters make off from the sale of these players alone… Plus most of the newer players have a newer feature — a USB port! What?

Yep, everybody knows what that means — what comes off your computer can now be copied onto media read from a USB flash drive or microSD chip. Even some car and motorcycle manufacturers are ofering installed radio stereo players equipped and programmed for USBs. Now cellphones use memory cards that can be read from card readers with USB connectivity.

Why?

It is no mistake that Sony and the the others in the big four had their fingers in a manufacturing pie that has exploited the playing of music from the manufacture and distribution of recording equipment to the manufacture and distribution of media such as CD’s and DVD’s to the manufacture and distribution of equipment to play this material (MP3 players, computers, cellphones and now — USB related media.

The Crown Jewels of music is embedded in your creative talents

Remarkably while this is going on unnoticed by the creative arm of the music industry — these same manufacturers are pocketing huge profits at the expense of the industry itself and it has gotten so bad that songwriters and artists are looking to alternative ways to market their music since the traditional methods, such as radio station promotions and record stores have gone south, so to speak! Talk about payola? Talk about conflict of interest?

Even major artists are turning from traditional and past-proven means of promoting their work to the internet via social media such as myspace, twitter, facebook and others.

So, it is “sink or swim” for anyone involved in the music business These days…

It’s everybody out for themself. literally. The Big 4 major labels have already declared the are Kings and divided their so-called music creative business interests into territorial Kingdoms of music so to speak. By controlling the media plays in equipment they manufacture they feel they have monopolized, owned sewed up have a complete grip on music creation itself — or so they thought — hence the original Napster messed it all up cuz they jumped the gun!

So now we have Grenigeech — Musical Feudalism. The Kingdom (Major labels) control the media and equipment and all the creative players and even consumers are divided into little territorial musical fiefs or fiefdoms.

With some help from Wikipedia (and a lot of creative editing – http://en.wikipedia.org/wiki/Fief) The fief (alternatively, fee, feoff, fiefdom), exists under a system of musical feudalism, often consists of prospective or revenue-producing property granted by a lord approved by the exalted ones. This is generally a vassal in return for a form of allegiance (usually given by homage and fealty). This fief originally gives one the means to fulfill ones contribution to the music industry when called upon. However, anything of value could be held in fief, title, a right of exploitation or any other type of revenue, rather than the copyrighted property it comes from.

Grenigeech - A call for revolution and parity in the music industry

But in the midst of all of this — Grenigeech is the revolution. Why be satisfied with a mere fiefdom when you can own and control your own Kingdom?

Kickradio is now ready to present and entirely new economic model for the music industry. This is a model whereby the creative arm of the industry such as songwriters and performers share in revenues with the media arm.

Ever wonder why we are offering the Kickphone? And why we plan to offer MP3 players in the near future? Why we are turning our attention to the microSD memory cards as the next generation of pmusic and video presentation media?

Its because we want to preempt, like the original napster, what the majors wanted to do all along. We want the creatives to be the ones to control the music industry and with your help we are working on solutions.

In the meanwhile, if you as a songwriter or musician feel like you have been robbed by johnny teenager in midamerica for downloading some of your tunes — look again. Great smokescreen. Its been obscuring your vision. The real culprits are those who have profited by the equipment and media that is used to play and mass produce copies of your works.

You’ve been duped.

Plain and simple. You can’t stop file sharing — ain’t gonna happen. Music enthusiasts are fickle and the practice is so widespread. Take two persons who own cellphones and put them into close proximity and they can even bluetooth the music files to each other (move over sexting — music pirates are at work here).

But you are in a position to exploit the technology with us. Join us here and join us now– help us with the crusade to carve out your own Kingdom. Its gonna happen anyway so why not be on the ground floor and be the ones writing the history rather than the ones reading about it!

The best way to make money as a performer is in performances at venues, gigs and concerts. But the cheapest and best way to attract paying customers to see and hear you perform is to get your name and music out. Right? What better way than through the mass distribution model that that the internet already offers! You can’t stop it so why not exploit it for your own gain. right?

Doesn’t matter if you are a major artist or an independent musician. If your name doesn’t get out then you are not gonna make it, no matter how good your stuff is. Hey, those old fashioned major labels used to promote you — but now they are absorbed, dead and buried in the maze of corporate profits. Now, if you are lucky enough to have a contract in most cases you are forced to pay your own way with advances against future earnings anyway. Ain’t no such thing as a free lunch anymore.

A Thought about DRM and Copyrights?

DRM (Digital Rights Management) is dead!

Thats right, the cat is already out of the bag (remember the original napster?) and the downloading and trading of digital music is so widespread worldwide that it goes beyond the definition of “pandemic”! And equally as difficult to enforce due to the enormity of the practice.

All of the major labels have already abandoned DRM-infected music releases.

But Ownership is not dead! What needs to be done at this juncture is to at least protect the creators and copyright owners. Most “Indies” (Independent Songwriters and Performers) already are keenly aware of this unique problem. The acknowledgement of a song’s title, songwriters, performers and copyright owners needs to be undeniably protected and enforced at all levels of music distribution.

Fair compensation? The industry has evaporated around this concept. New and unique methods of compensation to owners need to be developed and tested in a fair and free market system to allow the evolution of the next generation of music megastars.

Grenigeech is upon us.

A fragmented music industry is the next evolution. It doesn’t matter if you are a major artist or an independent artist. The rules are changing along with the times. Hold on to your shorts and certainly don’t bend over.

Limited Statutory License to Transmit in an Internet Radio Show

I. Definitions:

Except as otherwise provided in this document, as used in this document, the following terms and their variant forms mean the following:

“Copyright Owner”, with respect to any one of the exclusive rights comprised in a copyright, refers to the owner of that particular right.

“Digital Transmission” is a transmission in whole or in part in a digital or other non-analog format.

“Financial Gain” includes receipt, or expectation of receipt, of anything of value, including the receipt of other copyrighted works.

“Media Broadcast Network – MBN”, A privately held corporation to include it’s licensee’s www.KickRadio.com , www.ParadeOfSongs.com , Kickradio Magazine, www.top40charts.ning.com.

“Transmission Program” is a body of material that, as an aggregate, has been produced for the sole purpose of transmission to the public in sequence and as a unit.

“Transmit” to display and/or communicate works by any device or process whereby images or sounds are received beyond the place from which they are sent.

“Works” are material objects in which sounds, other than those accompanying a motion picture or other audiovisual work, are fixed by any method now known or later developed, and from which the sounds can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device.

The term “works” includes the material object in which the sounds are first fixed and includes any form of digital media used to transmit, transport or otherwise deliver said sounds.”

II. Scope:

Whereas this agreement is entered into between MBN and the copyright owner.

Whereas at the time of acceptance it is agreed and understood that all works provided by the copyright owner are done so under the provisions of Copyright Law of the United States of America and Related Laws contained in Title 17 of the United States Code specifically § 106. Exclusive rights in copyrighted works that states, in part, “The owner of copyright under this title has the exclusive rights to do and to authorize any of the following: (6) in the case of sound recordings, to perform the copyrighted work publicly by means of a digital audio transmission.
Whereas, as the owner of the copyrighted work, you hereby authorize MBN the exclusive right, free from any other agreements, encumbrances, liens or rights granted to other parties not a part of this agreement, to transmit this work by way of digital transmission, either separately or in conjunction with transmission programs, created and controlled by MBN.

Whereas it is understood that this agreement is free from any and all financial gain, that neither party will pursue financial gain at any time as a result of this agreement to transmit said work and that the transmission of said work is for the sole purpose of promotion for both MBN and the copyright owner.

Whereas you, the copyright owner, expressly warrant and represent the following to MBN and acknowledge that MBN is relying upon such warranties and representations as follows:

(a) That all factual assertions you have made and will make to us are true and complete; that you have reached the age of majority and are otherwise competent to enter into contracts in your jurisdiction; and that in any event you are at least 18 years of age.

(b) That you have obtained and hold all rights, approvals, consents, licenses and/or permissions, in proper legal form, necessary to submit Materials on the terms provided herein and to grant Media Broadcast Network the nonexclusive licenses set forth herein.

(c) That no other rights, approvals, consents, licenses and/or permissions are required from any other person or entity to submit your Materials on the terms provided herein or to grant Media Broadcast Network the exclusive licenses set forth herein.

(d) That your Materials are original; that your Materials were either created solely by you or, by written assignment, you have acquired all worldwide intellectual property rights in and to your Materials; that if your Materials contain any “samples” or excerpts from copyrightable work the rights to which are owned in whole or in part by any person or entity other than you, that you have obtained and hold all rights, approvals, consents, licenses and/or permissions, in proper legal form, necessary to use and include such work in your Materials; and that your Materials do not otherwise infringe on the intellectual property rights of any person or entity.

(e) That neither your Materials nor any comments or reviews you post on the Site violate any common law or statutory patent, copyright, privacy, publicity, trademark or trade secret rights of any person or entity and are not libelous, defamatory, obscene or otherwise actionable at law or equity.

(f) That you have neither intentionally nor with gross negligence submitted any Materials containing or producing any virus or other harmful code or other information that could damage or otherwise interfere with our computer systems or data and/or that of our customers, listeners and site visitors.

(g) You agree to sign and deliver to Media Broadcast Network any additional documents that Media Broadcast Network may request to confirm Media Broadcast Network’s rights and your warranties and representations under this Agreement.

(h) You acknowledge that Media Broadcast Network is relying upon the representations, warranties and covenants you have made herein. You agree to and hereby do indemnify Media Broadcast Network, its licensees, assigns and customers against, and hold them harmless from, any loss, expense (including reasonable attorney fees and expenses), or damage occasioned by any claim, demand, suit, recovery, or settlement arising out of any breach or alleged breach of any of the representations, warranties or covenants made herein or arising out of any failure by you to fulfill any of the representations, warranties, or covenants
you have made herein.

(i) All representations, warranties or covenants made herein by you shall survive termination of this Agreement.

(j) All warranties and representations made by you herein are made for the benefit of Media Broadcast Network and its sub-licensees and may be enforced separately by Media Broadcast Network and/or by any contractually designated sub-licensee of Media Broadcast Network.

III. Execution of Agreement

Therefore in consideration of MBN’s efforts to provide your work with worldwide public exposure you expressly authorize MBN to transmit in any manner, form or media whether now known or hereafter devised, any work you submit to MBN with the understanding that said transmission will be without limitations and
within the scope of this agreement as set forth above.

Therefor as the copyright owner you hereby expressly grant MBN and Kickradio.com a Non-Exclusive and Non-Transferable Royalty-Free License:

a) to make copies as necessary to transmit said work to the public for the sole purpose of promoting said work on behalf of you, the copyright owner,

b) to use your work for the purpose of promoting MBN’s products and services,

c) to use materials, as provided by the copyright owner to include all names, likenesses, biographical information, logos, marks or trade names of the copyright owner and individuals performing on or otherwise represented in or by this work,

(d) free from financial gain to you, any other persons, entities, groups or associations.

IV. Amendment and Termination

Any party to this agreement may request that it be amended, whereupon the parties will consult to reach a consensus on the proposed amendment. Where no consensus can be reached, the agreement will not be amended. Any signatory to this agreement may terminate it by providing thirty (30) days notice to the other parties, provided that the signatories and concurring parties will consult during the period prior to termination to seek agreement on amendments or other actions that would avoid termination.

Therefore it is agreed the rights and licenses you grant herein pursuant to this license shall terminate when, in accordance with this Agreement, you exercise your right to request removal of any or all works or materials freely provided.

You have rights! (Copyrights). This is a non-exclusive license agreement between you and the Media Broadcast Network and Kickradio.com which allows us to transmit your individual song, if selected, over our network and its affiliates. By submitting this form, below, you are agreeing to be bound by these terms and conditions.

Ok, here they look like they are American Indians, right?

But really they are India Indians…lol…Christopher Columbus move over cuz we found the real indians…

They just borrowed an interesting show look from Native American (formerly known as Indians) culture…

But the song they sing is universal — could be from any continent world-wide…

Kickradio is world-wide and we like to introduce NEW music from around the world… Abiogenesis is a rock/fusion band from Nagaland, India . Not satisfied with just playing mainstream music and their hunger to take music to a higher level, the band went further into exploration & experimentation which resulted in a new form of world music which they have named ‘Howey’ . . Howey is now Abiogenesis brand of music. It’s a fusion of folk tunes with various forms of modern music. They incorporate a part of the past and take it to the future through their music making giving an eclectic and genre-bending sound. They also play a new wind musical instrument made of bamboo invented by a band member Moa. Abiogenesis is the only band in the world that plays Howey & Bamhum. They also incorporate traditional musical instruments in their music. The band’s action-packed shows and positive do-or-die attitude are already getting increasing notice around the world, they have performed in hundreds of gigs in India,Thailand and Myanmar.

At any rate the video depicts a side of India in images that might surprise you… really, and Abiogenesis knows how to present it in a tantalizing style that stimulates your ears — ear candy, so be it!

USB is an acronym for Universal Serial Bus. This connection can be found on all new computers and many other electronic devices such as cellphones, printers and cameras.     The microSD chip when placed within a USB multi reader is the new delivery system for music and music videos. With one of these babies you can store and play literally hundreds or even thousands of songs and/or music videos virtually anywhere. We started looking at netbook computers and WiFi Hot Spot accessibility for internet connections and — BINGO! — it seemed logical that the new Kickphone should be flexible enough to include an actual qwerty keyboard for ease of use both as a phone and also like — well — like a mini computer that can operate in many of the hundreds of thousands of WiFi Hotspots around the world like fast food restaurants, coffee shops, airports and other areas where busy people gather who also want internet accessibility.
